Digital Millennium Copyright Act Policy and Takedown Procedures
DMCA Compliance
LustxHub respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our service.
If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our service by submitting a DMCA Notice. Upon receipt of a valid notice, we will take whatever action we deem appropriate, including removal of the challenged material from our service.
Copyright Infringement Notification
To file a copyright infringement notification with us, you will need to send a written communication that includes substantially the following (please consult your legal counsel or see Section 512(c)(3) of the DMCA to confirm these requirements):
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
- Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please include "DMCA Notice" in the subject line of your email.
Takedown Process
Upon receipt of a valid DMCA notice, we will:
- Acknowledge receipt of your notice within 24-48 hours
- Review and process the notice within 3-5 business days
- Remove or disable access to the allegedly infringing material
- Notify the user who posted the material of the takedown
- Provide the user with information about filing a counter-notice if they believe the takedown was mistaken
Counter-Notification
If you believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notification. To be effective, your counter-notification must be a written communication sent to our DMCA agent that includes substantially the following:
- Your physical or electronic signature
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided the DMCA notification or an agent of such person
Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. Please consider whether the material may be protected by fair use or other exceptions before sending a notice.
Repeat Infringers
It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers. We reserve the right to terminate user accounts for a single infringement in appropriate circumstances.
Users who repeatedly submit infringing content may have their accounts suspended or terminated, and their ability to upload content may be permanently revoked.
